### 1. Scope of Application

1.1 These Terms and Conditions (AGB) apply to all contracts and deliveries of goods made via the online shop www.designand3dprinting.de, owned by Norman Kunert, with customers who are consumers. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside his trade, business, or profession.

1.2 Unless otherwise agreed, the inclusion of the customer's own terms and conditions is hereby rejected.

### 2. Conclusion of Contract

2.1 The product presentations and descriptions in the seller's online shop do not constitute binding offers on the part of the seller, but serve to submit a binding offer by the customer. The customer makes a binding offer in the legal sense by placing an order.

2.2 After placing the selected goods in the shopping cart and going through the electronic ordering process, by clicking the "Complete Order" button, the customer submits a legally binding offer for the goods in the shopping cart. The confirmation of receipt of the order is sent together with the acceptance of the order immediately after the order is sent by an automated email. With this email confirmation, the purchase contract is concluded. Furthermore, the customer can also submit the offer via email (info@designand3dprinting.de). Should we decline the contract, the customer will be notified immediately by email. When choosing an external payment service (PayPal), the customer is redirected to the respective payment service provider's external website. The data relevant to the order is summarized in an "Order Overview" before submitting the order. Here, the customer can review and correct his information before sending his order. By clicking the "Submit & Pay" button, the customer makes a binding purchase offer regarding the goods he selected.

2.3 The contract text, i.e., the customer’s details for the ordering process, is stored by Designand3Dprinting - Online Shop and can be viewed by the customer under the link "My Account" and "My Orders". Independently, we send an order confirmation and these terms and conditions to the email address provided by the customer.

2.4 The only language available for the contract is German.

2.5 The customer must ensure that the email address provided for order processing is correct so that emails sent by us can be received at this address. Particularly, the customer must ensure that all emails sent by the seller or third parties commissioned with order processing can be delivered even if SPAM filters are used.

### 3. Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 Further information on the right of withdrawal can be found in the seller's cancellation policy.

3.3 The right of withdrawal does not apply to the following contracts:

- Contracts for the delivery of goods that are not prefabricated and for which the production requires an individual selection or determination by the consumer or which are clearly tailored to the personal needs of the consumer.
- The right of withdrawal does not apply to consumers who, at the time of concluding the contract, do not belong to a member state of the European Union and whose sole place of residence and delivery address is outside the European Union at the time of the contract.

### 4. Prices and Payment Conditions

4.1 Unless otherwise stated in the seller's product description, the prices indicated are total prices. Additional delivery and shipping costs can be found under "Shipping Costs" on the seller's website or in the respective product description.

4.2 Price errors reserved. If the correct price is higher, we will contact the customer. In this case, a contract is only concluded if the customer wishes to purchase at the correct price. If the correct price is lower, this price will be charged.

4.3 For deliveries to countries outside the European Union, additional costs may arise in individual cases that the seller is not responsible for and must be borne by the customer. These include import duties or taxes (e.g., customs duties).

4.4 The payment options are displayed to the customer in the seller's online shop.

4.5 When paying via PayPal, the payment processing is carried out via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, under the PayPal terms of use, available at: https://www.paypal.com/de/webapps/mpp/ua/useragreement-full. If the customer does not have a PayPal account, the conditions for payments without a PayPal account apply, available at: https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.

4.6 When paying in advance, you will receive our bank details immediately after placing an order. We wait for the receipt of your transfer and deliver your order as soon as your transfer has arrived. Please note that transfers (even online) take 1-3 business days and another business day for internal accounting. The ordered goods are reserved for 10 days. After the reservation period expires, the order will be deleted.

### 5. Delivery and Shipping Conditions

5.1 Unless otherwise agreed, delivery is made to the address specified by the customer. The delivery address specified in the seller's order processing is decisive. We also deliver to packing stations.

5.2 Delivery is made at the latest 5 business days after receipt of payment, unless a different delivery time is specified in the item description or expressly agreed upon. We accept no responsibility for delivery obstacles on the part of suppliers or manufacturers. If delivery or compliance with a specified delivery time becomes impossible due to circumstances for which we are not responsible, we are entitled to withdraw from the contract in whole or in part. The customer will be informed immediately in this regard. Claims for damages are excluded in this case.

5.3 If the delivery of the goods fails for reasons attributable to the customer, he bears the reasonable costs incurred by the seller. This does not apply with regard to the costs for the delivery if the customer has effectively exercised his right of withdrawal. For the return, the regulations stated in the seller's cancellation policy apply.

5.4 For local pickup, the seller informs the customer by email when the ordered goods are ready for pickup. The customer can then pick up the goods at the seller's location (Friedrich-Viertel-Str. 66, 09123 Chemnitz) after consultation with the seller.

5.5 Import duties for shipments abroad

For deliveries to countries within the European Union (EU), customs duties generally do not apply. However, additional customs, taxes, and fees may apply when importing goods into countries outside the EU (e.g., deliveries to Switzerland). All additional costs for customs clearance and other import and import fees are borne by the buyer. Please note: The customer bears all additional costs for customs clearance and import and import fees. We have no influence on these fees and cannot predict or influence their amount.

### 6. Retention of Title

6.1 The delivered goods remain the property of the seller until full payment has been made.

### 7. Liability for Defects / Warranty

7.1 If the purchased item is defective, the provisions of statutory liability for defects apply.

7.2 The warranty is excluded for defects caused by the customer. This is particularly the case for improper handling, misuse, or unauthorized repair attempts. The shortened limitation period does not apply to damages resulting from grossly negligent breach of duty by Designand3Dprinting, Norman Kunert. The shortened limitation period also does not apply to claims for damages due to negligent or intentional breach of essential contractual obligations. Essential contractual obligations are duties that enable the proper execution of the contract and on whose compliance the customer regularly relies.

7.3 The customer is requested to immediately report delivered goods with obvious transport damage to the carrier and to contact us as soon as possible. Failure to do so has no effect on the statutory or contractual warranty claims. The failure to report or contact serves only to support the provider in asserting its claims against the carrier or insurance.

7.4 If a manufacturer's warranty exists, the customer must assert claims directly with the manufacturer. Our liability under the warranty is excluded.

### 8. Special Conditions for Assembly and Installation Services

For the assembly or installation of goods, the following applies:

8.1 The seller provides services at its discretion through qualified third parties selected by it. The seller may also use the services of subcontractors who act on its behalf. Unless otherwise stated in the seller's service description, the customer has no right to select a specific person to perform the desired service.

8.2 Assembly and installation services relate exclusively to the goods offered in our online shop. Installation of products not offered by the seller is rejected.

8.3 The customer can find the relevant completion dates in the respective product description in the online shop and will be informed separately by email.

### 9. Redeeming Discount Codes

9.1 Discount codes can only be redeemed in the seller's online shop and only within the specified period. These are provided by the seller as part of promotional campaigns with a certain validity period.

9.2 Certain products may be excluded from the promotion.

9.3 Only one discount code can be redeemed per order before completing the ordering process. Subsequent settlement is not possible.

9.4 The discount is not refunded if the customer returns the goods reduced by the discount code within the scope of his statutory right of withdrawal.

### 10. Applicable Law

10.1 The law of the Federal Republic of Germany applies, excluding the laws on the international sale of movable goods.

### 11. Alternative Dispute Resolution

11.1 The EU Commission provides an online dispute resolution platform at the following link: https://ec.europa.eu/consumers/odr/. This platform serves

as a point of entry for out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.

11.2 We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board.
