  1. Scope
1.1 These General Terms and Conditions (GTC) apply to all contracts and deliveries of goods that are concluded and made via the online shop www.designand3dprinting.de , owner Norman Kunert and customers who are consumers. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.
1.2 Unless otherwise agreed, the inclusion of the customer’s own contractual terms and conditions is hereby rejected.
  1. Conclusion of contract
2.1 The product presentation and descriptions contained in the seller's online shop do not represent binding offers on the part of the seller in the legal sense, but serve to make a binding offer by the customer. The customer makes an offer in the legal sense by placing an order.
2.2 After the customer has placed the selected goods in the shopping cart and completed the electronic ordering process, a legally binding contract offer for the goods contained in the shopping cart is made by clicking the "Complete order process button". Confirmation of receipt of the order is sent together with acceptance of the order, immediately after it has been sent, by an automated email. The purchase contract is concluded with this email confirmation. The customer can also submit the offer to the seller by email ( info@designand3dprinting.de ). If we refuse to conclude the contract, the customer will be informed immediately by email. If an external payment service (PayPal) is selected, the customer will be redirected to the external website of the respective payment service provider. The data relevant to the order is summarized again in an "order overview" before the order is placed. Here the customer can check his details again and correct them if necessary before sending his order. By clicking on the "Submit & Pay" button the customer makes a binding offer to purchase the goods he has selected.
2.3 The contract text, i.e. the customer's details regarding the ordering process, is saved by the Designand3Dprinting online shop and can be viewed by the customer under the link "My Account" and under "My Orders". Irrespective of this, we send an order confirmation and these General Terms and Conditions to the email address provided by the customer.
2.4 Only the German language is available for the conclusion of the contract.
2.5 The customer must ensure that the email address provided by him for order processing is correct so that the emails sent by us can be received at this address. In particular, when using SPAM filters, the customer must ensure that all emails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.
  1. Right of withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Further information on the right of withdrawal can be found in the seller’s cancellation policy.
3.3 The right of withdrawal does not apply to the following contracts:
  • Contracts for the supply of goods which are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
  • The right of withdrawal does not apply to consumers who, at the time the contract is concluded, are not members of a member state of the European Union and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.
  1. Prices and payment terms
4.1 Unless otherwise stated in the seller's product description, the prices quoted are total prices. Additional delivery and shipping costs can be viewed under "Shipping costs" on the seller's website or can be found in the respective product description.
4.2 Pricing errors excepted. If the correct price is higher, the customer will be contacted. In this case, a contract will only be concluded if the customer wishes to purchase at the actual price. If the correct price is lower, this price will be charged.
4.3 For deliveries to countries outside the European Union, additional costs may arise in individual cases for which the seller is not responsible and which must be borne by the customer. These include import duties or taxes (e.g. customs duties).
4.4 The payment options are displayed to the customer in the seller’s online shop.
4.5 When paying via PayPal, payment processing is carried out via the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal terms of use, which can be viewed at: https://www.paypal.com/de/webapps/mpp/ua/useragreement-full . If the customer does not have a PayPal account, the conditions for payments without a PayPal account apply, which can be viewed at: https://www.paypal.com/de/webapps/mpp/ua/privacywax-full .
4.6 If you pay in advance, you will receive our bank details immediately after placing an order. We will wait for your transfer to be received and will deliver your order as soon as we receive your transfer. Please note that transfers (including online) take 1-3 working days and an additional 1 working day is added for internal booking. We reserve the ordered goods for 10 days. After the reservation period has expired, the order will be deleted.
  1. Delivery and shipping conditions
5.1 Unless otherwise agreed, delivery will be made to the address provided by the customer. The delivery address provided by the seller during order processing is decisive. We also deliver to packing stations.
5.2 Delivery will take place no later than 5 working days after receipt of payment, unless a different delivery time is stated in the item description or a different delivery time was expressly agreed. We accept no responsibility in the event of delivery obstacles on the part of suppliers or manufacturers. If delivery or compliance with an agreed delivery time is impossible due to circumstances for which we are not responsible, we are entitled to withdraw from the contract in whole or in part. The customer will be informed of this immediately. Claims for damages are excluded in this case.
5.3 If the delivery of the goods fails for reasons for which the customer is responsible, he shall bear the reasonable costs incurred by the seller as a result. This does not apply to the costs of delivery if the customer has exercised his right of cancellation in a timely and effective manner. If the right of cancellation is exercised in a timely and effective manner, the provisions in the seller's cancellation policy apply to returns.
5.4 In the case of on-site collection, the seller will first inform the customer by email when the goods ordered by him are ready for collection. The customer can then collect the goods on site (Friedrich-Viertel-Str. 66, 09123 Chemnitz) after consultation with the seller.
5.5 Import duties when shipping abroad
In principle, no customs duties are payable for deliveries to countries in the European Union (EU). However, additional duties, taxes and fees may be charged when importing goods into countries outside the EU (e.g. for deliveries to Switzerland). All additional costs for customs clearance and other import fees are to be borne by the buyer.
Please note: All additional costs for customs clearance and import fees are the responsibility of the customer. We have no control over these fees and cannot predict or influence their amount.
  1. Retention of title
6.1 The delivered goods remain the property of the seller until full payment has been made.
  1. Liability for defects / warranty
7.1 If the purchased item is defective, the statutory liability for defects applies.
7.2 The warranty is excluded for defects caused by the customer. This is particularly the case in the case of improper handling, incorrect operation or unauthorized repair attempts. The shortened limitation period does not apply to damages that are based on a grossly negligent breach of duty by Designand3Dprinting, Norman Kunert. The shortened limitation period also does not apply to claims for damages due to the negligent or intentional breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer can regularly rely.
7.3 The customer is requested to immediately complain to the deliverer about goods that have obvious transport damage and to contact us as soon as possible. If the customer does not do this, this will have no effect on the statutory or contractual warranty claims. Failure to complain or contact us merely serves to support the provider in asserting its claims against the commissioned transport company or insurance company.
7.4 If a manufacturer's guarantee exists, the customer must assert claims directly against the manufacturer. Our liability under the guarantee is excluded.
  1. Special conditions for assembly and installation services
The following applies to the assembly or installation of the goods:
8.1 The seller provides its services at its discretion through qualified third parties selected by it. The seller can also use the services of subcontractors who work on its behalf. Unless otherwise stated in the seller's service description, the customer has no right to select a specific person to carry out the desired service.
8.2. The assembly and installation services refer exclusively to the goods offered in our online shop. Installation of products not offered by the seller will be refused.
8.3 The customer can find the corresponding completion dates in the respective product description in the online shop and will be informed of these separately by email.
  1. Redeem discount codes
9.1 Discount codes can only be redeemed in the Seller's online store and only during the specified period. These are specified by the Seller as part of promotions with a specific period of validity.
9.2 Individual products may be excluded from the promotion.
9.3 Only one discount code can be redeemed per order before the order process is completed. Subsequent offsetting is not possible.
9.4 The discount will not be refunded if the customer returns the goods reduced with the discount code within the scope of his legal right of withdrawal.
  1. Applicable law
10.1 The law of the Federal Republic of Germany applies, excluding the laws on the international sale of movable goods.

11.1 All designs and products offered in the online shop www.designand3dprinting.de are subject to the copyright of the shop operator. Any reproduction, distribution or other use of the designs and products without the express permission of the author is prohibited and will be prosecuted.
  1. Alternative dispute resolution
12.1 The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr/
This platform serves as a contact point for the out-of-court settlement of disputes arising from online sales or service contracts involving a consumer.
12.2 We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
